These Terms of Service ("Terms") govern your access to and use of the ChartDatabase website, applications, and services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
1. Who We Are
"ChartDatabase", "we", "us" or "our" refers to ChartDatabase, operated at chartdatabase.com. Contact: support@chartdatabase.com.
2. Eligibility; Account Registration
- You must be at least 18 years old and legally capable of forming a binding contract.
- Provide accurate account information and keep it up to date. You may register with email or Google Sign-In. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
- One account per individual; shared or transferred accounts are prohibited.
3. Subscriptions, Trials, Billing
- The $39/month plan includes a 7‑day free trial via Whop checkout (payment method required). After the trial, monthly billing continues unless you cancel.
- Paid subscriptions renew automatically until cancelled. You can cancel at any time effective at the end of the current billing period (or during trial to avoid the first charge).
- Prices and features may change with prior notice. If you do not agree to the change, you may cancel before it becomes effective.
- Payments are processed by Whop. We do not store full credit card numbers. See our Privacy Policy for details.
4. Acceptable Use
You agree not to, and will not permit others to:
- Scrape, harvest, crawl, mirror, or bulk‑download data from the Service, including over websockets, except as explicitly permitted.
- Bypass or attempt to bypass authentication, rate limits, or security measures; probe, scan, or test vulnerabilities without written authorization.
- Reverse engineer, decompile, or otherwise attempt to derive source code or underlying algorithms except to the extent allowed by law.
- Use the Service to create a competing product, resell, sublicense, or publicly distribute our data, content, or metrics without permission.
- Interfere with or disrupt the Service (for example via bots that open excessive connections, send abusive alerts, or spam push notifications).
- Use the Service for illegal, fraudulent, infringing, or harmful activities (including market manipulation or sanctions violations).
5. Market Data and No Investment Advice
- The Service provides informational market analysis and alerts only. We are not a broker, exchange, or investment adviser.
- Nothing on the Service constitutes financial, investment, legal, or tax advice. Trading involves substantial risk, including loss of principal.
- Data may be delayed, interrupted, inaccurate, or incomplete. You are solely responsible for your trading decisions.
6. Intellectual Property; License
- All software, designs, content, and data generated by the Service are owned by ChartDatabase or its licensors.
- We grant you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Service for personal, non‑commercial purposes during your subscription.
- All rights not expressly granted are reserved.
7. User Content
To the extent you submit content (for example, watchlists or comments), you grant us a worldwide, non‑exclusive license to host and display that content solely to operate the Service. You represent you have all rights needed for any content you submit and that it does not infringe others' rights.
8. Third‑Party Services
The Service may integrate with or link to third‑party services (e.g., exchanges, payment processors, analytics, push providers). We are not responsible for third‑party services and your use of them is governed by their terms and policies.
9. Termination; Suspension
We may suspend or terminate your access immediately for violations of these Terms, suspected abuse, non‑payment, or risk to the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including IP, disclaimers, limitations, and governing law).
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION OR THAT DATA WILL BE TIMELY, ACCURATE, OR COMPLETE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.
12. Indemnity
You will indemnify and hold harmless ChartDatabase and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Service or violation of these Terms.
13. Changes to the Service and Terms
We may update the Service and these Terms from time to time. If changes are material, we will provide notice (e.g., by email or in‑app). Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and, if applicable, cancel your subscription.
14. Compliance and Export
You represent you are not located in, under the control of, or a national or resident of any country subject to embargoes or on any restricted party list. You will comply with applicable export, sanctions, and anti‑money‑laundering laws.
15. Governing Law; Dispute Resolution
These Terms are governed by the laws of Turkey, without regard to conflict of laws principles. Exclusive venue will be the courts located in Turkey, unless applicable law requires otherwise. Where permitted, disputes will be resolved by binding arbitration in Turkey under standard arbitration rules (you may opt out by emailing us within 30 days of account creation).
